AMNOG (Arzneimittelmarktneuordnungsgesetz) – Law on realignment of the pharmaceutical market in Germany

On January 1, 2011 the law regulating the reimbursement of drugs within the Germany’s statutory health care system (Neuordnung des Arzneimittelmarktes [AMNOG]) came into force.

The AMNOG allows for early assessment of the benefit of a medicinal product. Shortly after regulatory approval of a new medicinal product the “Gemeinsame Bundesausschuss” (G-BA; the Joint Federal Committee is the paramount choice-making body of the joint self-governing body of physicians, dentists, hospitals and health insurance companies in Germany) will analyse whether the new medicinal product shows additional benefit in comparison to a corresponding established therapy. Similar procedures have been introduced in many other European countries already.

It is plotted that the marketing authorisation holder (MAH) of a medicinal product can submit an application for the assessment of a potential additional benefit. To do so the MAH will provide the G-BA with a cost-benefit dossier (the value dossier “Erstattungsdossier”) and the G-BA or upon assignment the the Institute for Quality and Efficiency in Health Care (Institut für Qualität und Wirtschaftlichkeit in Gesundheitswesen: IQWIG) will conduct a comparative assessment of the additional benefit within 6 months. Based on the results existing or missing additional benefit will be determined.

In future there will be two institutions such as in various other EU countries: on one hand the competent authority for marketing authorisation (the BfArM and the PEI) deciding on the benefit risk ratio, i.e. the principle benefit of a medicinal product and on the other hand the authority deciding (G-BA as the choice making body) on the additional benefit (“Zusatznutzen”) ompared to existing therapies.

The new procedure of reimbursement

Following the marketing authorisation, the company will determine the price for new and innovative medicines for the first year after launch. During the first year the G-BA assesses whether the product offers an additional benefit or not. If an additional benefit has been established, the price of the new medicine will be negotiated between the Federal Association of the health insurance funds and the company. In the case that no additional benefit could be determined, the new medicine will be part of the fixed price system (“Festbetragsystem”) in accordance to their pharmacological profile.

Each medicinal products with new active substances which are launched for the first time will be assessed based on the “value dossier” prepared by the MAH. This dossier has to be submitted at latest at the time of marketing. This dossier includes information on the approved indication(s), on the benefit/risk and additional benefit in comparison to established therapies, on the target patient group(s), the costs of therapy for the health assurance funds. The company has to prove that there is an additional benefit. The evidence will be based on clinical studies conducted for the registration dossier. If applicable, additional special studies may have to be conducted as discussed with the G-BA and IQWIG.

It will be possible to meet with the G-BA prior to the submission of the dossier to discuss aspects of the products and the benefit for the patients and specific patient groups.

At the moment it is not clear how studies will have to be designed to examine the additional benefit. The endpoints based on which the assessment will be performed will probably differ from those used to investigate the benefit risk. Surrogate parameters may play a larger role when assessing the additional benefit as compared to conventional studies performed for registration.

The dossier is assessed by IQWIG and G-BA in a 6 month process. G-BA will choose on the additional benefit.

If rejected, the MAH can submit a new application to assess an additional benefit only one year after the first procedure.

The individual indications of a medicinal product will be analysed sequentially.

Agreement between the company and the health insurance funds

If a new medicinal product is not part of the fixed price system (“Festpreis”) the company will negotiate the price with the central federal association of health insurance funds (Spitzenverband der Krankenkassen). This will be done based on the benefit analysis and the cost-benefit analysis of the G-BA in accordance with the principles of quality, cost-effectiveness and the price of the medicinal product in other countries. The agreement can only be cancelled after one year.

If no agreement is reached there is an arbitration procedure. Both parties as well as independent members will be part of the arbitration committee (§ 130b Abs. 4 SGB V).

Cost-effectiveness assessment

After the arbitration committee has reached a choice, the party concerned can questioned for a cost-effectiveness analysis. In this case the G-BA will question the IQWIG to perform the analysis. This analysis will be based on clinical studies and will take a maximum of 3 years.

Agreement between the companies and individual insurance companies

Individual insurance agencies can enter into agreements with companies which differ from the established price; i.e. the insurance agencies can negotiate discounts. The physicians will have access to this information.

In the future the same regulations will apply for the private health insurance companies (Private Krankenversicherungen, PKV)

Orphan drugs

The regulations with regard to value dossier and reimbursement agreements are not applicable to orphan drugs. Since an orphan drug will only be approved for a rare disease with lack of adequate treatment, no evidence of additional benefit needs to be provided.

But, if the business volume of the orphan drug reaches 50 million EUR during 12 months then the additional benefit will have to be provided and a value dossier will have to be submitted.

In case indications outside the orphan diseases will be approved a procedure to determine additional benefit will have to be initiated.
